The legal case between the Arizona senator and the Pentagon returns to court this week.
WASHINGTON D.C., DC — The U.S. Department of Defense’s appeal against a court order blocking U.S. Sen. Mark Kelly’s demotion will be reviewed Thursday in an appellate court.
A panel of judges for the U.S. Court of Appeals was scheduled to review a case between the Democratic senator from Arizona and Secretary Pete Hegseth that stems from Kelly’s statements made in a social media video.
The Pentagon sought to punish the senator after Kelly appeared in a video with other Democrats that called upon service members to defy “illegal orders.” Hegseth then issued a censure letter, which could result in a demotion to Kelly’s rank.
Earlier this year, a district court judge ruled in Kelly’s favor by granting a preliminary injunction to temporarily block the Pentagon from disciplining the former Navy captain. The defense department appealed the judge’s decision, sending the case to the appellate court.
While speaking to the press following Thursday’s hearing, Kelly said he stood by his earlier comments and emphasized that he was “not backing down” from the legal fight.
